EUROPEAN VERSION (For consumers in the European Union / EEA – see below for the International version)

  1. Applicability These Terms and Conditions apply to all offers, orders, and agreements between BAROQCO and the Buyer. Variations are only valid if agreed in writing. “Buyer” means any natural person or legal entity entering into an agreement with BAROQCO. Buyer’s own terms do not apply unless expressly accepted by BAROQCO in writing. If any provision is invalid, the remaining provisions remain fully applicable.
  2. Offers and Orders All offers and quotations are non-binding unless stated otherwise in writing and valid for 30 days unless specified. Prices shown include VAT but exclude shipping, insurance, and handling costs unless stated otherwise. Images, descriptions, weights, dimensions, and colours are approximate; minor deviations do not entitle the Buyer to compensation or cancellation. Orders must be placed in writing (email or online). BAROQCO is only bound after written acceptance or order confirmation. BAROQCO may refuse orders, require advance payment, or demand security without stating reasons. Confirmed orders cannot be changed or cancelled without BAROQCO’s written consent.
  3. Prices All prices are in Euros and inclusive of VAT (for EU consumers). BAROQCO may adjust prices if cost factors (production, wages, taxes, exchange rates, etc.) increase after the agreement is concluded. Such adjustments do not give the right to cancel.
  4. Delivery Delivery times are indicative only and never strict deadlines. Delay does not entitle the Buyer to damages or cancellation. Delivery is ex works (Incoterms® 2020) unless otherwise agreed in writing. Risk passes to the Buyer upon handover to the carrier.
  5. Complaints, Guarantee & Right of Withdrawal Right of Withdrawal (Consumers only): You may withdraw from the purchase within 14 days after receiving the product without giving a reason. To exercise this right, notify us in writing (email to info@baroqco.com) within 14 days and return the product within 14 days after notification. Products must be unused, undamaged, with all original tags (including GENUINE BAROQCO label) and packaging intact. Earrings cannot be returned for hygiene reasons once the seal is broken. Custom-made or personalised items are excluded from the right of withdrawal. Return shipping costs are borne by the Buyer. Refunds (excluding original shipping costs) will be processed within 14 days after receipt of the returned item or proof of return shipment, using the original payment method.

Statutory Guarantee (Conformity): In addition to any commercial warranty, Dutch/EU law provides a minimum 2-year legal guarantee against non-conformity (defects present at delivery).

Commercial Warranty: BAROQCO provides a 6-month warranty against manufacturing defects under normal use. The Buyer must prove the defect results from faulty materials or construction. Minor or technically unavoidable deviations do not qualify. BAROQCO may repair, replace, or refund (at our discretion). Warranty lapses if the Buyer fails to meet obligations.

Complaints: Visible defects must be reported in writing within 5 days of delivery; hidden defects as soon as discovered (max. 5 days). Complaints do not suspend payment.

  1. Liability BAROQCO’s liability is limited to the invoice value of the defective goods. Indirect or consequential damages are excluded. Claims lapse 5 working days after they arise.
  2. Payment Full payment is required prior to shipment unless otherwise agreed. Late payments incur 1.5% monthly interest and collection costs (minimum 15% of the amount, min. €100).
  3. Force Majeure BAROQCO is not liable for delays or non-performance due to circumstances beyond reasonable control (e.g., government measures, strikes, natural disasters, epidemics, shortages, etc.).
  4. Applicable Law & Disputes Dutch law applies. Disputes are exclusively submitted to the competent court in Amsterdam, The Netherlands.

INTERNATIONAL VERSION (For business customers / non-EU – see above for the European version)

  1. Applicability These Terms and Conditions apply to all offers, agreements, and obligations between BAROQCO and the Buyer. Variations require written agreement. Buyer’s terms do not apply unless expressly accepted in writing. Invalid provisions do not affect the remainder.
  2. Offers and Orders Offers are non-binding and valid for 30 days unless specified. Prices exclude VAT, shipping, insurance, and handling unless stated. Descriptions and samples are approximate; deviations do not entitle cancellation or damages. Orders must be in writing. BAROQCO is bound only after written confirmation. Confirmed orders are final and cannot be changed or cancelled without written consent.
  3. Prices Prices are in Euros, exclusive of VAT, duties, shipping, and insurance. BAROQCO may adjust prices if cost factors increase after conclusion of the agreement.
  4. Delivery Delivery times are indicative only. Delay does not entitle damages or cancellation. Delivery is ex works (Incoterms® 2020) unless otherwise agreed. Risk passes upon handover to carrier.
  5. Complaints and Guarantee Complaints about visible defects must be made in writing within 5 days of delivery; hidden defects within 5 days of discovery. BAROQCO warrants soundness against manufacturing defects under normal use for 6 months. Minor/technical deviations do not qualify. Guarantee is limited to repair, replacement, or pro-rata refund at BAROQCO’s discretion. Complaints do not suspend payment obligations.
  6. Liability Liability is limited to the invoice value of the goods causing damage. Indirect damages are excluded. Claims lapse 5 working days after arising.
  7. Return Shipments BAROQCO does not accept returns of delivered and accepted goods unless agreed in writing. Returns are at Buyer’s cost and risk.
  8. Payment 100% payment prior to shipment unless otherwise agreed. Late payments incur 1.5% monthly interest and collection costs (min. 15% of amount, min. €100).
  9. Title and Risk Title remains with BAROQCO until full payment. Risk passes upon delivery ex works. Buyer may not pledge or encumber unpaid goods.
  10. Force Majeure BAROQCO is excused from performance due to circumstances beyond control (government measures, strikes, shortages, epidemics, etc.).
  11. Applicable Law & Disputes Dutch law applies. Disputes are submitted exclusively to the competent court in Amsterdam, The Netherlands.
